The Government has issued an updated version of its How to Rent guide and landlords are reminded they must ensure new tenants, or those renewing, have the correct version.

Section 21 notices will not be valid unless the correct How to Rent guide has been provided to the tenant, and this applies to both a new tenancy or a renewal, and also includes any tenancies that become statutory periodic tenancies, on, or after, June 26, 2018.

A Section 8 notice has not been affected by the new guide - and a tenant can still be evicted if they break the terms of their agreement.

Tenants who are currently within a fixed term do not need to be given a replacement version of the guide at this point.

The new guide has been updated to reflect legislative changes including information about the tenants' fee ban and the upcoming changes to the Houses of Multiple Occupancy (HMO) licensing and is now more user friendly.

The Government has also updated its ‘How to Rent a Safe Home’ guide and produced two new guides: ‘How to Let’ and ‘How to Lease’.

Only the How to Rent guide needs to be provided to tenants, with the others designed to advise landlords how to successfully and safely let out homes.

The last update to the guide took place in January this year to remove references to the London Mayor’s London Rental Standard which was abandoned in May 2017.
